1. Acceptance of Terms
By using the Trafficontent platform, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
2. Services Provided
Trafficontent offers AI-powered content generation, scheduling, and blog publishing tools. Services are subject to change or discontinuation at any time.
3. User Responsibilities
Users are responsible for maintaining the security of their accounts and the legality of content published through our platform.
4. Payment and Subscription
Some features require a paid subscription. You agree to pay all applicable fees and authorize us to charge your selected payment method.
5. Intellectual Property
All content generated using Trafficontent remains the property of the user. However, the Trafficontent platform, logo, and service framework are protected by intellectual property laws.
6. Prohibited Use
You may not use Trafficontent to create or distribute unlawful, harmful, or misleading content, or to violate the rights of others.
7. Termination
We reserve the right to suspend or terminate access to our platform at our sole discretion if you violate these terms.
8. Limitation of Liability
Trafficontent is not liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our services.
9. Changes to Terms
We may revise these Terms of Service at any time. Continued use of the platform after changes constitutes acceptance of the new terms.
10. Roles: Controller and Processor
For any personal data uploaded to or processed through the Service (including your recipients’ contact details), Customer acts as the Data Controller and Trafficontent acts as a Data Processor/Service Provider, processing such data on Customer’s documented instructions.
11. Email & Consent
Customer is solely responsible for obtaining and maintaining all legally required consents from recipients prior to sending marketing or promotional communications through the Service. Customer agrees not to upload purchased, rented, or harvested lists and must include a functional unsubscribe link in all non‑transactional messages.
12. Suppressions & Complaints
Trafficontent will automatically process unsubscribes, hard bounces, and spam complaints and will suppress affected recipients from subsequent sends. Customer must not attempt to circumvent suppression mechanisms.
13. Sender Authentication
Deliverability depends on proper sender authentication. Customer is responsible for configuring SPF, DKIM, and DMARC for domains used to send mail through the Service. Deliverability may be limited if unauthenticated domains are used.
14. Indemnity (Email & Privacy)
Customer will defend, indemnify, and hold harmless Trafficontent from claims, damages, and expenses arising out of Customer’s violation of email, privacy, or anti‑spam laws or the upload of recipients without proper consent.
